莫神星:论低碳经济理念下低碳能源的发展∗(四)

空白，解决现行法律难以解决或者没有解决好的问题。现阶段的能源立法更应着重解决能源领域突出矛盾和重点问题。在立法层面实现能源开发利用与生态环境保护协调发展理念，低碳经济理念下的能源法的生态化。能源法律政策的重心也应从着重稳定而充足的能源安全供应到注重减少温室气体的排放，保护生态环境，建设“低碳社会”，实现能源安全和环境安全的双赢。 结语 低碳经济提出的大背景，是全球气候变暖对人类生存和发展带来的严峻挑战。发展低碳经济是我们的必然选择，气候变化对我国现有发展模式、对我国以煤为主的能源结构、能源技术自主创新等领域均提出了现实的挑战。低碳经济是一种经济的发展方式，它不仅仅会改变能源结构，改变产品结构，而且会更进一步改变人类的生产方式和消费方式。未来我国能源发展必将从偏重保障供给为主，向科学调控能源生产和消费总量转变；从资源依赖型的发展模式，向科技创新驱动型的发展模式转变；从严重依赖煤炭资源，向绿色、多元、低碳化能源发展转变；从各种能源品种独立发展，向多种能源互补与系统的融合协调转变；从生态环境保护滞后于能源发展，向生态环境保护和能源协调发展转变；从过度依赖国内能源供应，向立足国内和加强国际合作转变。“十二五”期间，应该致力于转变经济发展方式，致力于发展低碳经济，致力于节约资源、保护环境、减少排放和维护国家能源安全。 Abstract: In the context of global warming and energy scarce increasingly, it is the development direction of China's energy and economic and social objectives of the exploitation and utilization of "low carbon energy" and the development of "low carbon economy", the construction of "low-carbon society" in the future.
