However, when it comes to the constituent elements of this special tort, whether civil law or tort law introduced recently failed to form an uniform standards, leading to many different theories about the constituent elements of environmental infringement formed in academia, and the big differences exist in elements of the illegality, no fault elements, the presumption of causation and damage elements especially. In this article, the author intends to say a few words on their views of these differences.
