任范围、责任内容及责任实现方式等一系列法律责任必不可少，而且应当从实体与程序两方面对其提供法律上的保障，通过建立专门的环境司法救济途径，更好地防治土壤污染行为的发生，维护当事人的环境权益，保护土壤资源，实现土壤资源的可持续发展。同时，通过对本国相关法律规定所存在的不足和空白予以分析，对症下药，借鉴国外有关土壤污染治理的责任制度，提出相应的解决机制，并通过建立一些特别的保障措施，如土壤污染防治基金制度、土壤污染的环境责任保险制度等，来构建我国土壤污染防治的法律责任体系。这样不仅对以后此类土壤污染事件的防范具有实践的指导意义，也为土壤污染防治责任制度的立法提供建议。 Abstract：In the paper, took threes heavy metal pollution events as the breakthrough point, through case analysis method to analyze the reasons and problems behind the reflected the legal responsibility. According to the laws and regulations related to soil pollution prevention, the analysis of the present situation of legal responsibility provisions was important, at the same time, through gaining experience on soil pollution control legal liability regulation from foreign developed countries and regions, combined with the situation of our country, put forward to build the legal liability system of soil pollution prevention. the author attempted from two aspects of entity and procedure to build soil pollution control legal liability system, the entity aspect, to establish three legal responsibility type of soil pollution control, including civil liability, administrative responsibility and criminal responsibility, and formulate the legal responsibility of related subject, responsibility constitutional elements and responsibility the way of achieving specific content. The procedure part, to establish the special environment of judicial remedy, including the establishment of integrated system of environmental litigation, environmental public interest litigation mode. Finally, based on the environmental pollution, especially soil pollution prevention really costs. Recommending the establishment of soil pollution prevention fund system and the system of environmental liability insurance and other social security measures should improve the construction of the legal liability system.
