As a result of the public nature of environmental investment and financing, the general investors lack the motivation of environmental investment and financing. For this reason, we must establish the foothold in aspects of law and policy to promote the activities of environmental investment and financing. We should improve the tax and credit policies, environmental information disclosure system and enterprise environmental management system, risk supervision system of environmental investment and financing. Key words: environmental investment and financing; incentive measures; environmental information disclosure; risk supervision 作者简介: 阳露昭,男,四川泸州人,中国海洋大学法学院教授,法学博士,主要研究方向为经济法学、环境与资源保护法学。 陈兆玲,中国海洋大学法学院经济法研究生。 政府选择了日本三菱株式会社和英国安格利安水务公司组成的联合体作为项目公司,以BOT融资模式建设北京第十水厂。项目因建设前出现的不可抗力——密云水库水源不足而被迫叫停,导致协议无法履行。如日本、英国方起诉政府,带来的国际纠纷会影响用水地百姓的利益,败坏政府的国际形象,此项目一度面临重大经济风险和政治风险。经过北京政府的积极努力,日本、英国方两公司退出项目,金州集团、北京控股公司取得特许经营权,在特许经营协议、购水协议、源水供应协议、补偿与争议协议等多个协议构成的完整的责任分配体系下,开始了项目为期23年的建设运营。 404 |
