The status of environmental refugees is very critical, while its protection of international law is indeed very weak indeed. This paper aims at analyzing the theoretical basis of the protection of environmental refugees, and tries to explore some good measures to protect them. The paper puts forward the concept of environmental refugee by the comparative analysis. The second part analyzes the basis of protecting environmental refugees from the perspectives of their particularities and the basic rule of environmental law. Moreover, the next part focuses on the exploration of the measures we can take based on the developing international law. The conclusion is that we should clarify the concept of environmental refugee and pay attention to their legal status. In this process, the protection of the environmental refugees stemming from global environmental problems should be the cooperation of all the subjects in the international community no matter they join the convention or not.
